Developments since entry into force of the Protocol

The COP-MOP, at its fourth meeting, considered a note by the Executive Secretary summarizing relevant information regarding the implementation of Article 25, including support for access and benefit-sharing from the Global Environment Facility; a proposal for a four-year outcome-oriented framework on programme priorities for the Convention and its Protocols, for the eighth replenishment period (July 2022 to June 2026) of the Global Environment Facility Trust Fund; and the sixth review of the effectiveness of the financial mechanism.

The COP-MOP adopted decision NP-4/8, urging eligible Parties to prioritize access and benefit-sharing projects during the programming of their eighth-replenishment country allocations under the System for Transparent Allocation of Resources and invited Parties to the Nagoya Protocol to participate actively in the sixth review of the effectiveness of the financial mechanism under the Convention. The COP-MOP requested the Executive Secretary to provide information on funding opportunities for supporting the implementation of access and benefit-sharing activities under the eighth replenishment of the Global Environment Trust Fund to eligible Parties. Furthermore, the Executive Secretary was requested, subject to the availability of resources, in the context of the sixth review of the effectiveness of the financial mechanism, to collect views and information from eligible Parties on their experiences and lessons learned in accessing and utilizing funds from the financial mechanism for the implementation of the Nagoya Protocol, including information on challenges and underlying reasons, to access and utilize Global Environment Facility funds and on possible barriers to regional collaboration.

The COP-MOP recommended that the Conference of the Parties at its fifteenth meeting include the following elements in the four-year (2022–2026) outcome-oriented framework of programme priorities for the eighth replenishment of the Global Environment Facility Trust Fund: (a) Specific priorities for continued capacity-building to support the implementation of the Nagoya Protocol; (b) Support for the integration and mainstreaming of access and benefit-sharing on genetic resources and traditional knowledge associated with genetic resources in policies and activities related to biodiversity and sustainable development; (c) Support for the development and sustainment of long-term institutional capacities for managing, monitoring and evaluating national access and benefit-sharing frameworks.

The COP-MOP also recommended to the Conference of the Parties, in adopting guidance to the financial mechanism, that it invites the Global Environment Facility to make financial resources available in a timely manner to eligible Parties to assist them in meeting their reporting obligation under the Protocol.

At its third meeting, the Conference of the Parties serving as the meeting of the Parties to the Nagoya Protocol (COP-MOP) considered a note by the Executive Secretary on the financial mechanism and resources (Article 25) of the Protocol containing information on sixth-replenishment support to the Nagoya Protocol and the seventh-replenishment programming for the Nagoya Protocol.

Accordingly, COP-MOP adopted decision NP-3/8, which encouraged eligible Parties to prioritize ABS projects during the programming of their seventh-replenishment national allocations under the System for Transparent Allocation of Resources (STAR) and to incorporate ABS activities in projects developed under other programmes of the Global Environment Facility. Furthermore, COP-MOP encouraged Parties to cooperate at the regional and subregional levels and to request support from the Global Environment Facility for joint projects in order to maximize synergies and opportunities for cost-effective sharing of resources, information, experiences and expertise.

At its second meeting, the Conference of the Parties serving as the meeting of the Parties to the Nagoya Protocol (COP-MOP) considered the update on the implementation of Article 25 of the Protocol prepared by the Executive Secretary (UNEP/CBD/NP/COP-MOP/2/5), containing information related to guidance to the Global Environment Facility (GEF), reporting, review of effectiveness, and determination of funding needs as well as the latest developments in resource mobilization for the Protocol. The COP-MOP adopted decision NP-2/6 which recommended, among other things, elements for inclusion in the decision on the financial mechanism to be adopted by the Conference of the Parties (COP) to the Convention, in view of the seventh replenishment of the GEF.

Decision XIII/21 of COP 13 contains the latest consolidated list of programme priorities and the latest four-year outcome-oriented framework of programme priorities related to utilization of GEF resources for biodiversity during its seventh replenishment period.

At its first meeting, the COP-MOP considered matters related to the financial mechanism on the basis of recommendation 2/1 of the ICNP and a document prepared by the Executive Secretary (UNEP/CBD/NP/COP-MOP/1/4), and adopted decision NP-1/6. The decision related to the operational arrangements between the Convention and the Council of the GEF with respect to the Nagoya Protocol and recommendations to Parties in relation to actions to be considered during the sixth GEF replenishment (GEF-6) period.

In decision XII/30, COP 12 invited the financial mechanism to implement the guidance provided by the COP-MOP in decision NP-1/6 in relation to programme priorities and eligibility criteria for GEF funding.

Developments prior to the entry into force of the Protocol

Prior to the entry into force of the Protocol, an interim body, the Intergovernmental Committee for the Nagoya Protocol (ICNP) was established by the Conference of the Parties to the Convention on Biological Diversity (decision X/1) to undertake the preparations for the first meeting of the Parties to the Protocol.

At its second meeting, the ICNP considered a note by the Executive Secretary on the elaboration of guidance for the financial mechanism (UNEP/CBD/ICNP/2/3), taking into consideration views and information submitted by Parties and other stakeholders on the issue. In recommendation 2/1, the ICNP made recommendations for the consideration of the first meeting of the COP-MOP and, in order to ensure the timely provision of guidance to the GEF on certain issues with respect to the Nagoya Protocol, also made recommendations for the consideration of the eleventh meeting of the COP.

In decision XI/5, COP 11 provided guidance to the GEF with respect to programme priorities for inclusion in the 2014-2018 framework, the Nagoya Protocol Implementation Fund and support for activities prior to the entry into force of the Protocol. Parties also emphasized the importance of having the necessary funds for activities to support ratification and the early entry into force and implementation of the Protocol.
